Hi All, has any body seen these guys around the bars in Udon(know of 2 bars that have been asked to add to the social fund,just for playing music),seems you need to pay 5000 baht for licence to play music not copyrighted to them but to other companies......Who gets the proceeds?......just asking for your thoughts........johnty. :-k

There is a requiremnet to get a licence if you play music that can be heard outside, as in most bars, however there is aso aneed to ensure that you have the original CD's in your possession as well, that is how i UNDERSTAND IT,, when day and Night openned there was discussion with the owners about a central music point where all would hear the smae music decided upon by the bars,but the bar owners said NO, hence possible probs there. Where the money goes I have no idea but the licence is a requirement, failing to obtain one can be an expensive proposition.

My understanding is somewhat similar to Pauls.
There are at least 2 BKK based companies that will supply anyone with a yearly license for 5K baht.
They arrive "mob" handed at about this time of the year in Udon. If a bar is playing music without one of these licenses (or, as Paul says without original disks) they will confiscate all music equipment (including any pcs) & arrest legal owner of bar & take to Police station. Here they will require 30K baht "fine" before release of person & equipment plus 5K for license.

many bar owners have been pulled for this in thailand, just ask justin... held his wife & bar staff to ransom.... NO JOKE

Interesting thought process for anyone thinking Thailand is a good place to open a business.If you create jealousy or resentment with your success,there are many ways to relieve or extort your profits from you :roll:
Doesn't mean it will always happen,but it is always out there, hanging over your head! :oops:

This happens all over the world. In the U.K. you must obtain a lic. to even show T.V., or have a radio, tape or CD playing for customers, in a bar, cafe, shop etc. The artist etc. gets a percentage of this. Even certain programs on T.V. like certain football matches, boxing matches, if you are displaying it to the public on your premises can cost a lot extra. This can amount to hundreds of pounds.
I think it comes under the performing rights acts.
If you look on a disc you should be able to see "no part of the program may be reproduced in any form. Unauthorized copying, lending, hiring,public performance, radio or T.V. broadcast or diffusion of this disc prohibited"

Personally if I owned a bar/restuarant in town I wouldn't bother with CD's whether original or copies I'd have a True Visions Sat dish installed and use their music channels. I'm guessing now but they probably have a higher charge for business customers. They have a decent selection of streaming music in different genres and a few radio stations to boot, probably enough choice to suit everyone.

You would still need to invest in one of these licenses even if you did it that way Kudjap.
The performing rights society are a very powerful organisation with the law in most countries 100% behind them. In the UK they claim that they have lost a legal case they have fought.

Not far wrong Stan. Last week a team were doing the rounds of Internet shops and I personally saw them checking some of the equipment in the shops upstairs in complex that are known to install copy Windows .Whether they will knock on individual houses though , I doubt. However old Bill must be feeling the pinch like the rest of us , so anything is possible . :lol:

There has been quite a bit in the Bangkok Post of late about a police anti-copy write squad checking some very large companies in BKK for illegally obtained software on their pcs & main frames - did not realise they were in Udon now TB....

Raally, I would have thought that as True Visions must have copyright licences to broadcsast and you're paying business rates to True Visions, which as far as I understand it the higher cost would be so you can show their TV progs and play their music to customers, it would have bypassed the need to personally buy one of these licences...... So are business rates to True Visions a farce.
There I go getting ahead of myself, I don't even know if True Visions have business rates.......
Does this only apply to music? What about showing TV progs. MTV, V etc etc
Do all the bars in Patters have these copyright licences? I somehow doubt it.....

I believe the 'business rate" is more to do with broadcasting live Sport which you do not need a license to do. If anyone broadcasts music (other than live, where different rules apply) in a business premise then they need a license for Performing Rights irrespective of any other local licenses that they will also need. True undoubtedly pay a fee to the Performing Rights - but that is for them to legally broadcast to their customers, not for onward public transmission. Any bars in Patters that do not have a license are newbies ready to be plucked. That is where these "enforcers" cut their teeth & set their rates.
