Oz Tourist Visa for Single Parent Child

Postby jackspratt » July 1, 2009, 3:11 pm

I am looking to take my wife and her 9yo son to Oz later this year.

The father did a runner many years ago, and I my wife has a document issued by the local Amphur office that gives her sole guardianship - which she used to get a passport for the son.

Conditions outlined in the Oz Immigration website are quite stringent in regards to children travelling with a single parent (ie without the 2nd parent).

Does anyone have experience with this, in applying for a visa at the Oz Embassy in either Bangkok or Vientiane?

Thanks

That document giving her sole guardianship is more than enough for Oz Immigration purposes. I did the whole process from tourist visa back in 2006 through to my wife and her daughter now being permanent reidents in Oz as of Jan this year. Our story is similar as the father bolted after her daughter was born and my wife didnt even have any official paperwork or custody rights. All we had to do was go to the local district office in Udon with a couple of family members as witnesses. They all gave a statement each which is recorded and my wife was given a document to verify the ex husband was long gone and all attempts to contact him had failed, which was verified in person and in writing by the two aunties, and this satisfied Oz immigration in relation to a prospective marriage and a spouse visa, let alone a tourist visa. You wont have a problem mate. Easy done. I have had alot of experience with all of these visas to Oz now and i have done all of them myself without any agents. If you need any further help or info, dont hesitate to PM me, i will be more than happy to help where i can.

Cheers

There were reports a few years back about sometimes having problems with Thai immigration at the airport w/o a permission certificate from the father! It seemed to be a hit and miss thing ,depending on the immigration person addressing the issue.

My wife has the same paperwork as mentioned in the above posts, but when we went to renew our daughters paasport in KK,they refused to do it w/o the fathers permission, her last name is his family name.We will be trying again in Udon ,noiw that they have an office there!

I took my wife and her 2 boys to Brisbane a couple years ago. She has same sole custody of her kids. We went through a visa service in KhonKaen and had no problems.

Easy fix for the passport renewal Stan. My wife just went to the district office in Udon and had her daughters surname changed back to her surname. My wife never took the fathers surname as they never registered the marriage at the office, they just had the ceremony only. I think, from memory, she only needed her and her daughters birth certificates, and the document verifying husbands wherabouts unknown, and she changed her daughters surname back then had a new passport issued in the new surname. I dont think she had any problems at all with the process...

Jack

The Oz embassy in Lao , normally is a overnight stay and pick up the visa and passport the next day, if all the papers are in place etc when lodged

The person issueing the Visa is actually from BKK and they do weekly runs to Lao for visa and other issues.

I did it this way before, Rang BKK to find out what days they will be there, made an appointment and a nice fast track, rather than going via the visa service agents they use in BKK to process the applications.

give me a PM if u want the 2nd consulates name and email address, she is married to a Thai guy from Nong Khai, got invited to the wedding, but wasnt in Thailand at the time.

Thanks for the feedback guys.

It seems the guardianship paper will be enough, but it needs to be officially translated and certified in accordance with Thai law.

Can this be done (translation and certification) in Udon, or do I need to go through the pain of the Thai Ministry of Foreign Affairs near Don Mueng in Bangers?

Jack,
Last I heard you can get the translations done in Udon, but must have all the fancy stamps done in Bangkok. My wife usually takes the option of having a Udon translation service send papers overnight to their bangkok rep, who gets all the pretty stamps done and sends back to Udon. Usually takes 2 to 3 work days to send and receive back, sometimes a few more days if around a holiday.

Jack, with all the visas we have done, all Thai documents must be traslated. We had some done in Bangkok and others done in Udon. I cant remember which ones were done where but Oz immigration accepted all wherever they had been translated. The ones we had done in Udon we dropped in the morning and picked up same arvo so they obviously didnt go to Bangkok. The ones we had done in Udon also were stamped and certified. As it was a few years back now, i cant recall (either can the missus) the name of the shop or wher in town it was. Sorry...

Good Luck

Does anyone know of a reputable translator in Udon who can perform the service Archie refers to above - hopefully without having to send the translated documents to Bangers for certification.

Thanks again.

Just a follow up to the above.

PW Translations (see BM's link above) did the translation of the Por Kor 14, which is the document awarding sole guardianship to (in this case) the mother.

Went to Vientiane last week (Wed) and lodged visa applications for mother and son at the Oz Embassy. Mrs crossed the bridge today, bringing back her 12 month multiple re-entry visa, and also the son's.

However, the embassy would only give a single entry, 3 month visa for the young bloke, and also told my wife future applications for him would have to be lodged in Bangkok. She was OK to lodge any time in Vientiane.

And yes, she also bought back a 3 litre box of delightful Chilean red wine :drunk:

So for those looking to take the Mrs (or mia noi, or both) to Oz, Vientiane is a convenient, and convivial, alternative application point.

Have to ask - Why would you need to prove sole guardianship for a tourist visa?

Over the years I have seen many mothers with children come and go at the airport and Im pretty sure immigation doesnt need the fathers permision for the mum to take the kids for a holiday.

I know at any time me or my wife can leave Australia and enter any country with our child without each others permission.

TIP: Be sure check the spelling of the name on any documents translated in Udon. If the spelling dont match the english spelling on the passport its next to worthless. We have been stung twice.

Ok I see why - Not sure I understand it

See: Form 1229 Consent to grant an Australian visa to a child under the age of 18 years (81KB PDF file)
