Thai age of consent?

Postby nkstan » March 3, 2010, 10:12 am

Does anyone know the legal age a Thai must be to act w/o parents signature on consent forms?I thought it was 18,but obviously it is not .

For some reason ,the passport office refuses to accept the paperwork used to get my daughter initial passport and wants us to get new paperwork which would mean going to Burriram and bangkok, rounding up relatives to witness etc.!And as there is no emergency need for her to have a passport at the moment,I don't feel like making the trips necessary because of her fathers extortive requests for his permission and signature!

if i'm not mistaken, i was under the impression it was 20. Ree just told me it's 21 for mandatory military service, though 18 if voluntary. it's 20 to enter an adult entertainment establishment/club, yet can work there at 18. marriage without consent 20, sex without jail 16 ???, younger with parents consent  .........20 to BUY alcohol, no age to drink :-k :-k . age 15, i think, and you must apply for gov't ID. 15 for MB driver's license, though only renewed on yearly basis until 18, then a 5 year is issued................again, I THINK, but i don't think i am too far off.

Stan, Ree just called local amphur office, and told 20 is the age for her to get passport and/or marriage without any parental consent.

i will search the rest of my guessimates, but think they are fairly accurate. repost if nobody corrects me, or not if i am correct.

working age for children is 13, with restrictions, no surprise, since gov't only provides 9 yrs of school, so at age 12, the should be done, unless paying to continue.

since on the subject of consent, sexual age of consent will usually come up, here is 'wiki' info, but take note, from the 1997 constitution, which no longer exist, not sure if criminal codes were changed when 97 constitution chucked out.
Thailand

The age of consent in Thailand is 15 (with the below caveat) as specified by article 279 of the Thai Criminal Code. The current legislation applies to all regardless of gender and/or sexual orientation, although it is a common misconception that it applies only to women.[citation needed]

However parts of the Prevention and Suppression of Prostitution Act which disallow any sexual contact with prostitutes under the age of 18, are widely interpreted by some local authorities to cover sexual acts classed as "obscenity for personal gratification". Also from the Penal Code Amendment Act of 1997 Section 283bis, having sex with a child under 18 is a compoundable offense even with the consent of that person. The parent or the child may file charges against the other side if he or she later regrets his or her own action. This ostensibly makes the Thai unfettered age of consent 18.

A high profile example of this application of the law was a statutory rape charge filed against the lead singer of the Thai band Big Ass for allegedly having had sex with a (then) 16 year old girl. The charge was filed by the girl after the singer refused to take responsibility for her baby. The singer has since been cleared of being the baby's father due to the results of a paternity test and he received 2 years suspended sentence.[37][38]

ok, back to my cave...........though think any info about children is important.........

'wiki' states purchase age for alcohol is 18, still none for drinking. though if not mistaken, IF they are carding, it's 20 to enter a club. :-k :-k

No, I don't think so. 2 times 1yr license, then 5yr. My stepson is on his second 1yr DL and expires this week. He's 17 and doesn't turn 18 until July, but he can obtain a 5yr DL...confirmed.

My wife was able to get my daughter's passport without the biological father's consent. She simply wrote something to the effect that he couldn't be found. No problems whatsoever. Hope it helps.

Cheers! ;)

Sounds like the age of majority is 20.Thanks
It doesn't say anything regarding new paperwork for passport renewals, guess it is th HNIC that determines it when you apply!

Looks like we will wait 2 years unless a very good reason presents itself before hand!

What passport office issued it and does your wife remember the official she talked to?

We had the sole custody papers from the amphur and got her passport in Bangkok at age 11,since they are only valid for 5 years,we reapplied in KK and we were refused because we didn't have fathers consent form,6 months later in Udon, same response!

Just a quikie, regarding passport no idea...sorry, but with education ALL Thai children should take GAT exam between 14-16 yrs old depending on date of birth etc.. After that it is up to the parents, however many do take their children pout of school due to costs etc, but really that is wrong.

hi stan,
if your present wife was not officially married with her former thai husband ,( i call it voodoo marriage) there will be no extortion what so ever, as according to thai law when not officially married custody always go's to the mother even the children bare the last name of the father, and he doesn't have to sign for anything... if they legally married in amphoe you do have a problem..., btw what passport office did you go, maybe try another one...( khon kaen, udon thani...)
