Thaksin's Control Left in no Doubt

It should be easy to discover who controls the judiciary. If they are appointed, find out who appoints them, or gives their approval to the appointment. I doubt that the prime minister appoints them or Thaksin would have been very foolish indeed to have appointed nominees who were bent on tossing him out, and charging him with crimes that are committed by many people in authority in Thailand.

Thailand's Supreme Court jailed three lawyers working for ousted premier Thaksin Shinawatra for trying to bribe a judge with 2 million baht (HK$465,000) in a candy box.

A three-judge panel found Pichit Cheunban, Thaksin's chief lawyer, and his two assistants guilty. Action on a separate charge of criminal bribery is expected, though the three denied any bribe attempt.

Their jailing comes weeks before a case against Thaksin and his wife.

from what I can gather, the Senate, Parliament and the Monarch, appoint the different Judges to different courts in Thailand..if a political party has a majority in the house, then they pick who they want..I dont think it is an independant body the appoints judges..

Here's a link with an in depth explanation of the Thai Judicial System. As best I can determine (from a quick read) there is no political appointment process to be a judge. Judges are appointed by The Judicial Service Commission which consists of 13 senior judges (inc the President of the Supreme Court) and 2 qualified non-judicial members appointed by the senate. There are several different classes of applicants based on their legal experience/education. The appointment of and removal from office must first be approved by the Judicial Service Commission for final approval by HM the King. Chapter 4 deals with the subject of how to obtain a judicial position, removal of judges etc.

I think the fact that the wealthy and connected people can get away with just about anything speaks for itself as to who controls the legal system.

I assume you're speaking of all legal systems and not just this one. I don't think it's really manipulating the judicary (the courts) as much as finding and working the legal "loopholes" in the system. It appears to me that the system here has many more loopholes than what you might find in most western countries. The other aspects of the judicial system that you're ignoring are the prosecutors & police both of which are much more open to manipulation. The courts have to rely on both the prosecutor's office and the police to present the case to the court. The prosecutor makes the ultimate decision regarding what charges to bring against the person. It's relatively easy to file lessor charges against an individual if the prosecutor is inclined/influenced to do so. The court only judges what is presented to it by the prosecution. The courts here are just as independant as in most any western country as best I can determine.

Yes, Khun Jack, this is very good. What do you think really happened? Do you think Thaksin was outbid? Do you think the judges got an offer that they could not refuse? Or, do you think they are very honest law-abiding fellows bent on uprooting corruption wherever and whenever it appears in Thailand?
