i have a friend , who has had an accident yesterday evening , he was driving to udon on the sakon nakhon road double lane all ready , he was driving left side as a motorbike come's out straight of a left side street crossing the main road (like a dog)meaning to u turn 300m further....( thai style) , so the result , my friend hit him with his car and he and motor bike slipped into the ditch , result again, car all broken in the front ,including windshield, lucky this guy was wearing a helmet ..only hurt his leg,some idiot called police ( rule nr1 in thailand never call police ) they came , he had to tow away the car to the police station ( not his home ...) because he did not want to pay the 3.000 bath the motorbike driver asked him , what police come do there ? make a report , who is wrong who is right , surely not ...., in all sircumstances the motorbike is wrong ..., this morning i went there to give advice and the motor bike driver was all ready there to claim his 3.000 bath , also insurance visited them early saying they must fix it at the police station tomorrow , my friend have only grade 3 insurance, what would be enough in this case,motorbike also have insurance the guy said, ( the police check this when accident involving falang?) as in many of these cases his wife thinks it is normal to pay the guy..escaping the wrath of the family?????, so my question is to hear as most off opinions we can get about this , as i think he did not do anything wrong , is it because falang , he must pay all even the motorbike is wrong , i know the bikes and motorbikes are considered the weaker users of the road , and are also more protected when they have an accident , but not when they are wrong, so the result here would be my friend has to pay this idiot who drive with his motorbike against his car 3.000bath , and have to fix about i would guess 25.000 bath for his car , which normally the insurance of the motor bike has to pay, what those the thai law say???
, pfff what a story, as they must go the police tomorrow morning any quick advice is welcome, i know i am not your favorite person , but as this is not about me i thank any one for any answer....as i want to help my friend.............

Hey KopKei, I had this discussion with the little lady a while ago. She told me that in all cases involving a motobike and a car, the car driver is liable, no matter whos fault it is. If he gets off with 28,000 for the repairs and payment to the motorbiker driver Id say he should count himself lucky. I know this isnt the answer you were looking for but its just my opinion.

Also if anyone can correct me on an accident with a motorbike and a car Id appreciate that as I just heard it from the wife

Im pretty much sure you are on the right lines Dermot , sounds unfair but thats usually the outcome - purely hypothetical question what if the farang is on the bike and a Thai is driving the car ?? perhaps adifferent outcome when down the police station unless accompanied by the missus. (my own experience)

I would pay the 3 k to the idiot and do my car on insurance and get it cleared up asap.

There have been numerous cases reported on UM and other forums where a motorcyclist in the wrong has been held to be at fault, and either got nothing, or even had to pay the car owner.

So Dermot it appears to be a (Thai) urban myth about the farang/car driver always being liable.

The other issue is one of convenience, and mash may be quite right to suggest paying the 3k to make it go away.

so if i do understand this all right, next life i want to be reborn as a thai man , using an old motorbike targetting all cars driven by falang , and only have to pick up the money? , in my country motorbike and bicycles are the weak users , but not when they do idiot and also do not respect the law...., thailand really monkey country??????
btw nr 3 insurance does not cover this damage done to his car , and not his fault....
if this happens between thai only insurance would have take care this all ready fair....

A young lad smashed into my car speeding on an old motobike , no brakes and carrying loads of pork to/from the market , i was expected to pay for his bike and medical - i refused .......... luckily for me he was found to be an illegal Lao worker so this all went away very quick as his boss at the market didnt want any probs as he employed many aliens , my point however is i was informed at the police station that i woild be liable if he was Thai NOW THAT STINKS , also anyone living in los with a car should never only have no3 insurance as its not worth the paper its written on , if you cant pay for 1st class insurance its safer not to get the car in the fist place IMO

as i said i would pay the 3 k to ge this sorted quick.

well dermott , when i want to visite ireland will i have same problem ? i know different country different laws , what do you think the outcome would be if this was about all thai accident , ask your wife , GF

hi mash , responding to your answer the car of my friend ( 70years old, the friend, not the car..) 50.000km ( the car not the friend..) was not able to get nr 1 insurance anymore , but good car until yesterday....

you are all quickly to say pay the 3.000 bath and move on ( forgetting the 25.000bath to fix his car???, even not his fault??) where is all your integrity here ????or must we lose all this because TIT.....

what the point in having insurance, i did have grade 3 insurance long time a go , had small accident backing up the car on central plaza parking , did not pay anything , insurance did , even the mini bus drivers outside on the parking advised me to pay the lady 1.500 bath as she wanted, as the damage was about 500....... ..

Of course you wouldnt have the same outcome if you were in Ireland KopKei, dont be silly. But Thailand isnt Ireland and foreigners dont have the same rights that you enjoy in the more developed world in Thailand. Ive had this discussion many many time about different things and guess what, if you are not Thai, you lose. Im not arguing its right, its just the way it is, right or wrong! In fact to be honest I wish Ireland would have the same attitude as thais do. Foreigners here seem to have more rights than I do! How right is that?

Obviously your mate is in the right Kopkei, Im not denying that, but this is Thailand and he is not thai. Pain in the ass I know but those are the facts.

I just asked the wife and she said the person on the motorbike is not liable even thai on thai!

Jack made a point above that some foreigners seem to have had success. I suppose if they want to go to court etc maybe they will. But also maybe the court costs and the hiring of a solicitor would outway the cost of just paying for the damage himself. If it were me Id choose to pay the little scumbag the 3000 baht and pay for fixing the car myself but thats just me.

P.s. If 28000 baht is going to break the bank for him then maybe he shouldnt be in thailand!
