Visa (O-A) rules

Postby Ray.Charles » May 25, 2010, 1:46 pm

My O-A (long-stay) visa was issued (in New York) on 1 September, 2009 for entry before 31 August, 2010.
I entered Thailand on that visa on 14 October, 2009, and was stamped admitted until 13 October, 2010.
I went out of Thailand earlier this month and got back last Sunday ,May 23, 2010, and was stamped admitted until May 22, 2011.
I have plans for one or more trips outside of Thailand in the near future. As long as I reenter before 31 August, 2010, written on the visa issued in New York, I am assuming the stamps will be dated as in the last 2 times.
Two questions:
1. What should I do if foresee that I will not return before 31 August, 2010.
2. My next 90-day report is due on 7 July, 2010. May I assume that every time I renter, my 90 day reporting date is automatically reset? That is even if I do not leave Thailand my next reporting date will be 90 days from May 23, 2010.

Thanks for your help.

Each time you leave and re-enter prior to 31 August, 2010, you will be given a further 12 months eg re-enter 30 August, permitted to stay until 29 August 2011.

If you are not sure whether you will re-enter before 31 August you will need a re-entry visa, which will allow you to come back up to 22 May 2011.

After 22 May 2011, you will need either to get (have got) a new visa (O-A or O), or an extension (requiring income and/or money in a Thai bank).

Or you can do 15 day border runs for as long as they tolerate it.

The answer to your second question is yes.

Hi,
Going home in a few months for a holiday. I have a extension to my "O" visa, for retirement, According to immigration in Udon I have to fill in a form TM8 before I leave LOS otherwise I will only get a "visa on arrival" stamp when I re-enter LOS.
Would be grateful of any advice from someone that has done this.
Thanks Doug.

YES YES YES, what you do is to request a travel outside the country stamp this willcost you I beleive Thb 1000:0 this will then ensure you get a re-entry stamp when you come back.
You might be prepared to stipulate why you are going for a long time, because they may think that you are working in your own country therefore not give you a re-entry stamp which means you have to go through the rigmarole again.
It is perfectly in order to apply but for a very long time might raise eyebrows, so think of a few good excuses.

Ray,Charles Jackspratt

I am confused. I have been in Thailand since 2004 on a Single Entry O-A Retirement Visa. I have made a number of land trips outside the country and have always been told I would need a Re-Entry Permit (TM-8) to return to Thailand in order to preserve my O-A Visa. My passport has always been stamped upon return "permitted to stay" & the expiration date of my annual visa. I have never received an extension of my O-A visa based on travel outside the country. If I understand you both then one would never need to renew the annual visa as long as you continued to make trips outside the country. Please correct me if I'm wrong as I could save myself the 1,000B fee for the re-entry permit.

A re-entry permit only protects you from losing whatever visa you have when you actually leave the country. It allows you to return without losing your existing visa, which then upon your return, continues until it's expiry date, as stamped in your passport.

Before your visa expires, you would still need to fulfill the relevant requirements to renew it or to be absolutely correct extend it, (within Thailand).

fd the difference is you are getting a single entry, so it is effective only up until the time it expires ie 12 months after it is granted. After the first entry (ie the single entry), you are then on re-entry permits if you wish to leave and come back.

With a multiple, you can leave and come back as you wish in the first 12 months, and you will get the extra 12 months if you do a run just prior to the end of the first 12 months. In the second 12 months, you also need re-entry visas if you wish to leave and return. The maximum period of the re-entry visa is the date of the expiry of the second 12 months.

The visa questions and answers are as clear as mud
briefly
1. get a retirement visa or a one year visa of any hue....live here for one year, then renew....if you wish to travel outside thailand get a TM 8 filled out and signed by immigration ( this will ensure when you come back YOUR original visa is OK and will end on the original date of expiry given when granted.
2. get a mulit entry year visa you can leave at will but every year you must then renew.
years visa you MUST renew every year...no matter whether you travel or not.
Clear,,,,,,,,,,,,,,umm speak to Immigration they are helpful , at least now they are in Udon.

I understand what Jackspratt is saying I just don't understand why you would essentially get a one year visa free. If what Jackspratt is saying is correct and if I understand him correctly you would never have to apply for another visa. At the end of the second year simply travel outside the country again and get another 12 month extension free of charge and without the hassle of going to immigration.

Please correct me if I'm wrong. I am always open to new ideas and a better way of doing something.

Mike the second year is a once off. At the end of that (second) year you need to obtain a completely new visa ie start again, or apply for yearly extensions, based on money in the Thai bank and/or income etc.

Jackspratt

Thanks for the clarification. What does a multi-entry 1 year O-A visa cost?

In Oz, $225. I understand the (rough) baht equivalent is TBH6000 - converted to your local currency.

OK thanks. I didn't realize this had to be purchased outside the country.
