I have a friend who is getting divorced and is filing for custody of their 2 year old, who was born in Thailand. Mark wants to move to Thailand to live, he's a writer and works from home, so my question from him is; is there a visa that allows him to remain in Thailand, and not do the regular border runs, to look after the child, he's not yet 50 so a retirement visa is not available. Anyone know?
BTW - he's got an appointment wth the Thai embassy in London booked for next week to discuss this but just thought I'd see if any member is in this position and how they deal with it.

Non-Immigrant Type O Dependent Visa is for foreigners who have children or parents who are Thai citizens. Apply at your local Consulate.

Hi,
Best bet is as mak says A non imm. "O" visa. From U.K. you can get a multi "O" visa. About 100GBP's in U.K.. This will last for about 15 months, when worked correctly. You will still have to do border runs every 90 days.
You can also get a single "O" visa and a couple of weeks before it expires go to Thai Imm. and apply for a extention to stay due to looking after a Thai National. You will still have to have the money in the bank, or a income as stated by Thai. Imm.
You cannot obtain visa's for LOS in LOS, has to been done in your country of residence. Or outside of LOS. You can get a permission to stay, as above, from LOS Imm. but also have to report to LOS Imm every 90 days. No need to leave the country to do this. I just go down to Udon Imm. every 90 days. This is just a check to see if you a still living in same place, and have not moved. Every 12 months. you have to reapply. Jump through all the hoops again. Imm. would not take my income tax forms, from my gov., as proof of earnings. and i have to go to the B. Embassy to get a letter from them every year. Costs about 2,300B. and a trip down to BKK.

Thanks guys, thought I'd read about a dependant visa somewhere but didn't realise it was one where you had to hit the border every 90 days. Guess the money in the bank this for the extension is the same as the marriage or retirement visa?

I believe you're wrong regarding the 90 day across the border. I believe this type of visa is handled the same way as a marriage visa without the requirement to leave the country every 90 days.

I have a non-Imm O visa and married, and still have to do a border run each 90 days.

Is your non-imm O visa based on marriage or just a non-imm O visa? You shouldn't have to leave the country if you have a non-imm O visa based on marriage as long as you can provide the required income proof, a marriage license, and photographic proof that you and your wife are living togther. Other required docs include the house papers from where you're living and a copy of her ID card.

Please correct me if I'm wrong.

Perhaps the confusion lies in the difference between the (initial) O visa - which requires 90 day border runs , and the (latter) extension, which (as I understand it), does not require border runs.

yes Doug I also obtain embassy letter from UK embassy each year they require proof of income or pension. However never had to Bangkok, just do it by post. Letter took 5 days in all :D

This particular visa can be done easy , and you will hear so many differing storis ref application .

I have been on the non imm 0 / dependancy visa for 7 plus years , as a single parent/legal guardian i obtained custody of my son when he was 4 yeas old now 11 , same visa , runs yearly tho i tag on a 6o day extention every year to make it run 14 months i report every 90 days at the local immo office BUT DO NOT LEAVE THE COUNTRY .

Paper work is

Amphur custody letter and divorce agreement .
Divorce certifiate.
Tab ban proof of address.
School report if at school.
Photos of child t home address x 4 inc bedroom and outside .
Bank book and letter from bank showing min 400k in a Thai bank , this must stay in 2 months before renewal.
Passport and completed relevant forms from immo.
Usual photos .
2,900 bt fee.

If you leave the country you can get a re-entry permit so as keeping the same visa , as i said ive had the same visa now for 7 full years and just renewed no probs.

So in essence the dependant visa is treated the same as a marriage visa albeit slightly different paperwork is required to obtain it. This should help Mark out, don't think he has any thoughts of remarrying at present but doesn't want to take his child back to the UK just yet.

Guess the meeting he has with the Thai embassy soon will confirm this but I'll pass on this info so he's prearmed, Thanks again Mr Mashman

No problem Chriss , if any more info required drop me a pm . The divorce and custody agreement is the key to getting this visa, doesnt matter if the applicant re marries here in los or not .
