Hi all

Cheers for all the help and interest shown ,,,, I think in our case leasing the land will be a no no because I want to live in community / type estate with communial swim pool etc ,,,,,, so that option will not be available .. I am personally not looking at it as if its the end of the world for me if this were to happen ,, I would accept I have to walk away and leave to her family ,, I asked the question more for info regarding future financial planning . Thanks for all replies ,, it has thrown up some interesting points

Yes Terry has that same lease after his devoirce and still lives on the property. The ex tried to contest it and force a sale she was not able to do so.

You really have to ask yourself in the event of untimely demise or divorce:- "Do I really want to live here"? Would you have ever considered coming to Isaan if you hadn't been lead by the short and curlies in the 1st place?

If it wasn't for the great relationship I have with TW I wouldn't be stuck out in the middle of the rice paddies, that's for sure. Goes back to the grand old saying --- and you all know it: "Don't spend mo ------------ loose". Be prepared to walk away and start afresh!

The term was "short and curlies"! Not sure whether you misunderstand the slang or trying to say something else?

yes always be prepared to walk away..but I can see a situation where one has a lovely wife and leases some land, and builds a home, and unfortunately the wife passes away after some years..it may well be in rice paddy country, you may welll have found your niche in the village community and wish to say on..or you may wish to sub lease, or rent the house out for a while and collect an income, and come back years later..you may want go back and forth to your homeland, 6 months on, 6 months off, but at least with a lease you have options like that..if it is the other senario where it ends up in messy divorce and the village turns against you for some reason, you can still walk away, maybe even sub lease depending on the original lease contract....me I am a rice paddy man anyday, and I dont mind being stuck out in the middle of nowhere with or without a TW....

What I would like to see with my future 30yr lease is that my son and daughter who love thailand too, can take over the lease and enjoy the place should I die. if I left a spouse behind I would also make sure she was not disenfrancised by giving her the right of habitation to the lease land and home. My idea would also be to purchase some land during the marriage that would be hers alone upon my death..the lease land is to cover my bases should I marry the wrong girl, but still want a base in thailand..

This is not a troll, but I believe that this is not an usual reply. Please try to understand meaning behing my words. What means relationship, family and sharing to you (not anyone specially)? Maybe fun and own happiness?

eagle - I actually think a lot of people here live like that but are afraid of being ridiculed by the cheap charlies so they don't post. Me, I don't give a FF what most folks think. I spend a lot of money on myself and my family. I've yet to see a coffin lined with 1,000 baht notes.

Hello LDB; from one thread to another!! The above reason (eagle's I think) was exactly why I leased the land from my GF, that in the event of her death I wouldn't have to go through any legal shenanigans to stay there.
Not that I was petrified of her kicking me out :(
It was her idea aswell.
Totally agree with your comments above, a CC's over-caution can be self-destructive.

patriot - if I could turn back the clock I would have had a village wedding and not gotten legally married. The wives prefer the village wedding anyway as it brings "great face". Getting legally married can create a real hassle depending on how things unfold in the future. Anyway my marriage seems strong and the wife puts up with me (hard at times as I can get a bit moody). If we have problems in the future I'll just have to deal with it; that's life.

By law a Thai of any age can have land held in their name. In practice you are at the mercy of the particular land dept staff that you deal with - and they all have differing version of the law. Some will say must be old enough to sign, some will say 15, 18, whatever.
Re: 30 year lease. As far as I am aware there has never been provision in modern thai law for leases longer than 30 year term. I have never heard of an instance where a court cancelled a lease on divorce, and would be interested to hear of anyone with first hand experience with this

I think that a falang that thinks the family ever accepts him as their family,is in for the shock of his life!I am sure there is always the possibilty of an exception,but it would be like winning the big lottery prize.As long as you are an economic advantage to them,you will be ''tolerated'',anything,bye bye without a thank you.We all know how really appreciative Thais,in general,, are for everything you have done for them :lol: :lol:

Foreigners’ right to property was the final topic, with officials listing the requirements for owning and buying condos. Additionally, the spouse of a Thai person can inherit one rai of land for residential or commercial purposes or 10 rai of agricultural land if their Thai spouse dies. If the spouse held more than the requirement, then the foreign partner has one year to sell or to give away. Thai children can inherit from their parents, and foreign parents can buy land for their children if they are minors but must apply for a court ruling before purchasing.
