who owns the pictures I post???

General Udon Thani topics only!

who owns the pictures I post???

Postby uncle tom » September 10, 2006, 1:32 pm

I plan to post some pictures on the forum but I read the Forum Rules and User Agreement. Now I don't know what to do. The Agreement says....

6. All content posted on the message boards of udonmap.com is the exclusive intellectual property of udonmap.com. Copyright ownership resides in that content by udonmap.com and the Company is free to use any of the content as they wish. Anyone other than udonmap.com seeking to reprint, republish, or reproduce content posted on the udonmap.com message boards must receive the express written permission from the Webmaster of the udonmap.com forum in which the content was posted. By posting on the udonmap.com message boards you are agreeing to the above and relinquishing all copyright to the contents of the post(s) to udonmap.com.

Will I really lose control over my pictures if they are posted on the message boards ?.

Seems to say that, could be that is exactly what it means.

Must be some good photos to be concerned, if they are, you might think twice

"... is the exclusive intellectual property of udonmap.com"

It says udonmap.com will have the exclusive ownership of the pictures. In theory, you would not be able to post the pictures again, even on your own website or use them for any commercial purpose unless you obtained permission from udonmap.com.

This also raises the really sticky problem that can occur when one posts pictures that one does not own. For example, if I were to post a picture I found on the web that is owned to the Bangkok Post, and then I posted here. I think that means that I just gave something owned by the Post to udonmap.com. This could result in a lot of pain and expense.

I suspect it is not the intent of udonmap.com to take ownership away from anybody. It woud be a great relief if the wording were to be modified to reflect udonmap.com's actual intent or dropped completely.

It should be noted that similar wording is used on many messageboards and web-based services, so its always to check for the intellectual property rights statements in the terms of service on other sites before you post anything.

Oh, darn. Now I don't own this message anymore...

Yes it seems title does pass to Udonmap. I have wanted to quote from a book I have written previously, but my publisher being aware of the terms has advised me against it.

This is actually a copyright issue and is more directed at the worded content as apposed to images. Say if another website were to copy an article posted on udonmap.com and then post this on their website, they would be required to state its source i.e. extract taken from udonmap.com.

It's the same what you would do if you copied a story from stickman's website or the Bangkok Post, you would wrap the post in a quote and give reference to its source. This therefore avoids copyright issues.

With regards to images, it's not actually possible to upload pictures onto this forum, the only way to do this is by clicking the 'add image to post link'. This opens a popup window and directs you to a free photo hosting website, you then upload your picture to this independent website and the script creates a link to this picture in the post. This means that the image does not reside on udonmap's server and is therefore not the property of udonmap.com. I have no idea what the user agreement says on this independant website, but if you're worried then I would advise checking it out.

If you're concerned about photo ownership please place a ฉ copyright by watermark in one of the corners. Without one of these little babies, anyone on the whole World Wide Web can claim ownership of your cherished snaps.

P.S. Air Asia used some of our Udon Thani photos for their website without our permission and gave a reference to TAT, as did udondee and a private blog site. Since then we have added the copyright by watermark on all our photos.

i am not sure i should post any pictures at all. I may have undeservedly built up expectations.

The Photos are rather ordinary but fun. I often laugh when I see them but that doesn't mean others will like them. I know if i stick with rocket festival pictures at least THAI-1-ON will appreciate them.

I now have a Nikon coolscan 35-mm scanner for my slides, It's great toy but sooo slow.

I'll have some photos ready by tonite or tomorrow for sure.

Thanks all for your feed back.

tom
