TransCanda Commences Legal Action

Post by Jing Jing » January 8, 2016, 9:29 am

A shot across the bow of the President  who is a constitutional law expert.

"TransCanada Corporation announced today it has filed a Notice of Intent to initiate a claim under Chapter 11 of the North American Free Trade Agreement (NAFTA) in response to the U.S. Administration's decision to deny a Presidential Permit for the Keystone XL Pipeline on the basis that the denial was arbitrary and unjustified. .. Through the NAFTA claim, TransCanada will be seeking to recover more than US$15 billion in costs and damages that it has suffered as a result of the U.S. Administration's breach of its NAFTA obligations." TransCanada.com

TransCanada subsidaries TransCanada Keystone Pipeline LP and TC Oil Operations Inc [both US registered companies] have filed a lawsuit in the U.S. Federal Court in Houston, Texas, asserting that the President's decision to deny construction of Keystone XL exceeded his power under the U.S. Constitution. Politics first. Obana saw the opportinuty to score political points by cancelling the Keystone Pipeline project and at the same time help fellow democrat H. Clinton who had expressed her opposition to the project. Should this legal action proceed it would take years to be resolved and by then Obama and possibly Clinton would be long gone and be spared the blame. The US government , the US tacpayers would come in to cover any damage.

yes, purely political.. And, note he refused to approve the Keystone XL portion of the Keystone oil pipeline project only.. The remainder of the original Keystone pipeline project was completed several years ago and connects Canada with refineries in Texas.. The XL portion was a shorter path from the Canadian border southeast across the upper mid-west and connecting into the Keystone pipeline... The irony is here that when the last section of the original Keystone pipeline actually connected it down to Texas, Obama lauded it as an economic plus.. https://en.wikipedia.org/wiki/Keystone_Pipeline

TransCanada maybe looking at the next election. Hedging its bets. Before Hillary was against the pipeline she was for it. Did TC make a "donation" to the Clinton foundation? And why is there a former TC lobbyist on the election staff?
